    Introduction

    1. Introduction: Arson

Arson is simply criminal damage committed by fire — but because fire is so dangerous and unpredictable, the law treats it as a more serious offence in its own right. For a solicitor advising on a criminal matter, recognising when a case is arson rather than ordinary criminal damage matters enormously: the aggravated form is indictable only and carries up to life imprisonment. You'll need to identify which form applies, what must be proved, and which defences are realistically available.

This lesson builds your understanding step by step:

    1. The Offence and Its Forms — what arson is, and how basic and aggravated arson differ in elements and seriousness.
    2. Basic Arson: Actus Reus — the by-fire conduct, what counts as 'property', when it 'belongs to another', and what amounts to damage by fire.
    3. Mens Rea — the intention or recklessness required, and the subjective recklessness standard that applies.
    4. Liability by Omission — how a failure to act can ground arson where a duty to act exists.
    5. Aggravated Arson — the extra endanger-life mental element and why no one need actually be at risk.
    6. Lawful Excuse and Intoxication — the statutory defences, the role of honest belief, and how intoxication is treated.
